Policy claim is granted after 3 year of policy term

https://www.irda.gov.in/admincms/cms/whatsNew_Layout.aspx?page=PageNo2648&flag=1

To all the Life Insurers
Ref:IRDA/Life/GDL/MISC/186/10/2015Date:28-10-2015
Applicability of provisions of Sec 45 of Insurance Act 1938 in various scenarios
After amendment to Section 45 of Insurance Act 1938 , we have been receiving queries from the Life Insurers with regard to the application of new provisions in various scenarios that can arise during the course of life insurance policies in general and more specifically the approach to be taken for refunding premium , once the insurer takes the decision of repudiating a policy on the ground of misrepresentation or suppression of the material fact made by the policyholder / life Assured to effect or continue a Life  insurance policy.
The queries raised with regard to various scenarios and the view taken by Authority is as follows:

Q1: In case of delayed intimation by the claimant i.e. where death of the life assured has occurred within 3 years of effecting the policy, but death claim intimation is given late by the claimant (whereby the period of 3 years from the date of effecting/revival of the policy is over). In such cases, since the period of 3 years will be over, whether the insurer has the option to call the policy in question?

Answer: The Insurer has only 3 years window for calling a policy in question on the ground of misrepresentation or suppression of a material fact not amounting to fraud, from the date of issuance of Policy or date of commencement of risk or date of revival of policy or date of rider of the policy, whichever is later. It is regardless of whether claim has arisen or not and when it is intimated. Once this period of 3 years is over, the policy cannot be called in question.

Q2: Whether the period of 3 years within which a policy can be called in question by the insurer is to be interpreted as date of effecting the policy till the date of death of the life assured (or) date of effecting the policy till the date of repudiation (if any) by the insurer.

Answer: The 3 years period is not necessarily connected with death claim arising under the policy and is counted from the date of issuance of policy or commencement of risk or revival or rider whichever is later. A Policy can be called in question within 3 years even if there is no death claim.

Q3: In case of ULIP polices, whether to refund the entire amount of premium received or pay only the fund value + refund of risk premium.

Answer:

a)    In case the policy is called in question within 3 years from the date of issuance on the ground of misrepresentation or suppression of a material fact not amounting to fraud :

The premiums collected under the policy up to the date of repudiation are to be refunded. It has no relevance to the fund value.

b)    In case the policy is called in question within 3 years from the date of last revival for the statements made at the time of revival :

Fund Value as on preceding day to the date of last revival + the entire premium collected for revival and thereafter would be refunded.

Q4: In case of a policy which has run for more than 3 years and acquired paid up value results in claim within 3 years from the date of last revival and it is found that there was suppression of material facts at the time of issuance of policy, whether premiums collected under the policy since inception is to be refunded.

Answer: As the time of 3 years has already elapsed from the date of inception/ issuance of policy, there is no scope of calling the policy in question as per amended Sec 45.

Q5: However in the above case, if it is found that there was suppression of material facts at the time of revival, then the revival is treated null and void. Whether the premium collected under the policy since inception should be refunded?

Answer: The revival of a policy is treated as a fresh contract and if the policy         (revival) is called in question within 3 years of such revival, the premium collected from date of revival of the policy to the date of repudiation is to be refunded along with all the admissible benefits accrued as on the preceding day to the date of such revival.

Q6: In case of Money Back plans, where one or more Survival Benefits (SB) are paid and the policy results in claim within 3 years from the date of subsequent/ last revival and it is found that there was suppression of material facts at the time of issuance of policy, whether the SB already paid should be recovered from the premium amount refundable.

Answer: In the given scenario, 3 years period to call has already elapsed from the date of issuance of policy, hence, there is no scope to call the policy in question.

Q7: In the above case if there was suppression of material facts at the time of revival and revival is treated as null and void then whether to refund the premiums collected under the policy since inception after deducting the SB amount paid or to just refund the premium collected for revival of the policy and not recover the SB paid prior to revival, but recover the SB paid after such revival, if any.

Answer: The revival of a policy is treated as a fresh contract and if the policy          (revival) is called in question within 3 years of such revival, all the premiums collected from  such revival of the policy to the date of repudiation along with all the admissible benefits accrued as on the preceding day to the date of such  revival (after adjusting the SB  amount paid, if any) are to be refunded.

Q8: In the Act there is no mention of claims arising within 3 years of Reinstatement of Surrendered policies.

Answer: Reinstatement of surrendered policy can be treated at par with the revival of the policy. Further it is clarified that calling a revival or reinstatement or reinstatement of surrendered policy in question will only arise if any misstatement / suppression of material facts is made at the time of revival or reinstatement of surrendered policy.

Q9: Where the Date of issuance of Policy and date of Commencement of Risk are different, how the refundable premium would be calculated.

Answer: If the Policy is called in question within 3 years of date of issuance or date of commencement of risk, whichever is later and the insurer takes a decision to repudiate the policy, the premiums collected from the date of issuance till the date of repudiation shall be refunded.

Q 10: if a policy is revived/ reinstated by collecting arrears of premium with interest and without obtaining a Declaration of Good Health/Medical, can it be repudiated within 3 years?

Answer: No. Since the policy is revived without taking any document/ statement from the policyholder, there is no scope for repudiation within 3 years of such revival.

Former President & eminent scientist Dr APJ Abdul Kalam passed away in Shillong on Monday. Kalam collapsed during a speech at IIM Shillong and was immediately rushed to the nearby Bethany Hospital.
Here are some of Kalam’s inspirational sayings through which he will be remembered forever…
“You have to dream before your dreams can come true.”
“If a country is to be corruption free and become a nation of beautiful minds, I strongly feel there are three key societal members who can make a difference. They are the father, the mother and the teacher.”
“My message, especially to young people is to have courage to think differently, courage to invent, to travel the unexplored path, courage to discover the impossible and to conquer the problems and succeed. These are great qualities that they must work towards. This is my message to the young people.”
“To succeed in your mission, you must have single-minded devotion to your goal.”
“Let me define a leader. He must have vision and passion and not be afraid of any problem. Instead, he should know how to defeat it. Most importantly, he must work with integrity.”
“Great dreams of great dreamers are always transcended.”
“Let us sacrifice our today so that our children can have a better tomorrow.”
“Man needs his difficulties because they are necessary to enjoy success.”
“Look at the sky. We are not alone. The whole universe is friendly to us and conspires only to give the best to those who dream and work.”
“You see, God helps only people who work hard. That principle is very clear.”

Do self help books really work?

Breaking the Myths
It is very funny to hear out these objections against the self-help books; even the people who have not read a single book have an opinion about them. Can you comment on the entire Bollywood film industry after watching few films by KRK (Kamaal R Khan)? How can you comment about the entire self help and personal development industry without reading at least 50 books? Through this write-up, I just want to clarify three few things around Self-help industry:
1. Nothing works if you do not work on yourself: We underwent formal education for 20 years, and then we had to work on what we learned to make a living. Likewise if you read a self help book, then you have to take action on the information mentioned in those books. Trust me; it will not take you 20 years to transform your life. Surprisingly, after 5-10 books on a particular subject you begin to understand what is stopping you from living the life you want to lead.
Personal development or self-help books push you out of your comfort zone and exhort you to explore your potential. The strategies, tool and stories shared in these books can save you a lot of time and costly mistakes. Get all the information and then use your intellect to decide how you are going to use that information. How can information about your unlimited potential be bad? It is the way you use that information that makes it good or bad. Reading a book does not change your life, taking action on what you read will surely change your life.
2. Why reinvent the wheel? A lot of us keep our problem for a long time, because we want to be the first ones to solve it. Every problem that you have ever faced or will ever face has a solution which has been documented by someone in the form of a book or a seminar. Never let your ego come in the way of learning. I think self help is the best help because there is no one who is going to come from outside to change your life. Any person who is reading this is a human being, and every human being has some problems and dreams which we want to solve and achieve respectively. Even the dreams you have in your mind, have been achieved by someone else and all the strategies that were used by them are available under the so called ‘self-help’ category that you have been avoiding for years. It is silly to spend 5 years on a goal that could have been achieved in 5 months. When I face a challenge, the first question I ask myself is – what are the 3 books I need to read to solve my problem? More often than not, I find the answer in the personal development books.
 3. Solution is already out there: The steps to success and happiness have already been figured out for you. If you have the luxury of time, then you may spend years in figuring out what is already known but no wise person should ideally do that. There are books that can teach you- how to start a business from scratch, how to be a leader in your company, how to be a great student, how to be a great spouse, how to be a great parent, how to do meditation, how to have more money, how to have great relationships, and how to lead a healthy life. These books have been written by people who have already produced great results in their lives. If an author spent 5-10 years to identify a solution to one of the problems that you are facing and he has documented it in a book which you could be read in a matter of 10 hours, you would be a fool not to access that powerful treasure of perspective. Thus, the only thing you must check is the credibility of the author. The books keep you inspired and tell you that you are bigger than your problems and can achieve all your dreams. I am a big fan of personal development industry, and I believe that we all need some coaching in certain areas to live a better quality life. I became an author 6 years ago but I have been reading self-help and personal development books for over 16 years now. This one habit has helped me in helping and serving people through coaching and counseling. Remember it is not about self-help, it is about success strategies. And beware of the author who tells you that your life will change only by reading his or her books.

5 foods that can control diabetes

Here's what to eat if you want to control your blood sugar levels.

Dates: This brown and sticky fruit not only has a sweet taste but is rich in fiber, making it a diabetes-friendly snack. According to a study, they are richer in antioxidants as compared to a serving of grapes, oranges, broccoli and peppers. Have raw dates or stuff them with walnuts.

Bad habit to quit for a healthy living

You became an 'Owl' at night

Many of us, burn the midnight oil for exam preparations and work. But if this becomes routine, you will damage your body in the long run. Without 6-8 hours of good sleep, you are damaging your immune system and other body processes and systems. Due to lack of sleep, your immune system becomes weak and thus produces fewer 'germ fighters' - lowering your tolerance for withstanding common bugs in your environment. To fight against various diseases, it is necessary to at least get a minimum of 7-8 hours of good sleep on most nights of the week. A good night's sleep also helps you stay awake and fresh throughout the day.

I am so 'lonely'

Dr. Vahia says - the key for good health is a healthy and fresh mind. If your mind is unhealthy, it will affect your immune system and put you at several health risks. If you spend most of your time obssessing over your loneliness, and any other social challenges, or whatever could cause feelings of despair and frustration, then you are harming your mental health, detaching yourself from people, and stressing your mind and body.

Wearing headphones for long hours

Headphones or earphones are the sole companions for some of us throughout the day. We listen to music to pass time, while travelling or while working out. But, if you have plugged in for hours, with no breaks, then you need to keep this habit under check. Dr. Vihang says - listening to loud music via earphones, can cause hearing loss. He further adds - headphones aren't the culprits, it is the volume and the hours that can land you in trouble. Besides, ignoring minor symptoms of hearing loss is also one of the biggest criminals.

TV trouble

Sitting for hours on the couch, watching that idiot box can put your heart and eyes at risk. Watching too much TV can put you at an increased risk of heart attack, stroke and obesity. The more you are glued to the TV, the more immobile life will affect your levels of fat and sugar in your blood. Besides, it also strains your eyes and causes damage to the refractive lens.

Wearing heels

Women who wear heels on a daily basis, do lots of harm to their bodies. Dr. Tina Mahendraker - Physiotherapist, Mumbai says - high heels can affect your posture, put pressure on joints - which can cause arthritis, back pain and tendon injuries and other heels related accidents. Thus to prevent such horrible effects on your health Dr. Tina says - limit your heels to not more than 1.5 inches, and wear insoles to reduce the pressure on your joints.

Carrying an extra heavy bag

We love to carry our world wherever we go, because we can't afford to miss a single thing. This habit of hauling the world with our (lots and lots of) worldly things on the back or shoulder causes lots of harm to our health. Carrying heavy bags can cause various long term effects like serious back pain, neck pain and poor posture - says Dr. Tina. Hence, to avoid ageing your body prematurely, do yourself a favour and empty that bag.

Snacking, even if not hungry

If you disrupt your regular eating pattern, then your body will no longer send hunger signals and you may end up eating even when you are full. This extra eating can flood your body with extra calories and unhealthy ingredients, which can further cause serious chronic health problems like diabetes, heart problems and acidity.

Lying constantly

Surprised to see this one on a healthy living post? Those minute white lies can cause serious damage to your health. If you lie constantly, you will have constant fear of the truth being disclosed, this will create a feeling of stress in you, says - Dr. Vihang. Stress, is the worst thing for your body, as it damages your heath due to the release of stress hormones. Besides, it further leads to headaches and anxiety.

Skipping breakfast

Breakfast is the most important meal of the day - says Ms. Eileen - Nutritionist, Mumbai. If your entire breakfast comprises one cup of rushed coffee and a toast, then you're setting yourself up for an unhealthy future. This will affect your digestive system. Besides, it will also harm your energy reserves and negatively affect your metabolism. If you skip your breakfast, you are likely to eat more during the other meals and this can lead to weight gain. Eileen says - the key to a good breakfast is a balance of protein, fat and carbohydrates.

Ignoring sex

Whatever the reason for a low libido might be, whether too much work or stress, avoiding sex altogether for many days and months at a time is not good. Sex is good for you and your health. It helps to improve your immune system and relationship. But if you are not interested in this pleasurable act, then you need to talk to your doctor immediately. Because, a low libido can be beyond stress, it can be caused due to an under active thyroid, hypertension or simply a hormonal imbalance.

Fast eating

Eating at lightning speed due to work pressure or lack of time can adversely affect your digestive system. You should take at least 20 minutes to finish each meal. If you just gulp your food, without chewing it properly, it can cause acidity, bloating and excess gas in your stomach. Hence, slow down and enjoy your food.

Bad habit to quit for a healthy living # 20: Picking at your skin

If there is some flaw on your face, you must resist yourself from constantly stressing on it. If you constantly keep worrying about acne by touching it, it will act up more. Besides it will lead to scars and inflammation. Hence, stop picking at your face to avoid worsening skin issues.

Saving Smartly! 10 Quick Tips To Get You Started

Money saved is money earned. Make this your mantra in 2015 and begin your journey on the road to riches. Work fetches money and that is what keeps us going. But how about money fetching more money?

That's exactly what your goal should be. And the first step for that is learning to save. It does not mean you cut down on occasional weekend dinners or not give in to the retail therapy once in a while. Saving need not be boring. You just need to think a little and make it a part of your lifestyle. Make saving a habit by being intelligent, creative and join the cool 'rich' club.

#1 Review that home loan
Take time out to review the interest that is paid on your home loan. There is so much competition for this product in the market and you must take advantage of this. Make sure your bank is giving you the best deal. If not, compare and negotiate!

#2 Too many cards kill the budget
Empty those credit cards from your wallet and pick two which you want to continue with. The deciding factors should be reward points and low interest rate. Since, most of the time, one credit card carries only one of these benefits at a time, it is a good strategy to retain two cards. Having limited cards also helps keep a tab on spending habits. Spending is done more consciously and unnecessary expenses are automatically cut down.

#3 Savingup tips for car loans
Negotiate for better rates using your CIBIL credit score. Lenders often offer lower rates for borrowers with better CIBIL scores. Also, make sure you don't finance the car add-ons. For the accessories or add-ons check with local dealers for better rates. That way it turns out to be a cheaper option, rather than paying interest on it up to the entire loan repayment.

#4 Get organized and play CID
Arrange for all bills, statements, etc. to reach you before a pre-decided date every month. On a weekend evening, analyze and check for mysterious charges. This habit will also help you recognize your spending patterns. These can then be corrected or can be planned for in advance thus helping you in the save money mission.

#5 Plan ATM trips
Impose a restriction on your ATM visits. This simple act helps in numerous ways. Expenses are planned in advance since cash needs to be withdrawn accordingly. There is no room left for temptation to withdraw cash whenever an ATM is in the vicinity. Many banks have started charging customers for ATM usage when the number of transactions cross the permitted transactions number. By planning withdrawals in advance one can easily avoid bearing such charges.

#6 Savings while getting insured
No one understands your needs like you do. Do your homework and work out your own insurance amount. Agents have a tendency to talk you into more. Also, before buying any new insurance check if you are already adequately covered under an existing insurance scheme. If not, go in only for the additional amount. It is also a smart thing to shop around a bit after you have worked out the requirements. Go for an insurance plan that suits you the best. And while at it, remember that insurance works best when it is not coupled as a saving plan.

#7 Track your expenses
Have a personal tracker to keep a check on your daily expenses. Either maintain a small diary if you are old school, like geeks do or download a mobile application which will help you with this. Analyzing expenses on a regular basis can prove to be a very effective way to save on expenses which are not accounted for or are unnecessary.

#8 Choose banks wisely
Take stock of all the bank accounts and lockers which you own. It's time to de-clutter and get organized. Shut down accounts which have not been used for regular transactions since six months or more. Also, check on the lockers currently in use. It is not uncommon to change lockers along with a change in address. However, the old lockers remain in your name. Closing old accounts and lockers can free up the deposit money which can be reinvested as per your own.

#9 Save up during sale season
Retail therapy indulgence reaches new levels during the sale season. While discounts on products leave you with some free money after the purchase, why not make this free money work for you. Next time you avail a discount, deposit the discounted amount into your savings account and incorporate it in the investment plan.

#10 Don't leave your investments unattended
While one does feel a sense of relief after planning, choosing and implementing an investment scheme, it is important to note that these investments need to be reviewed regularly. A decision made two years ago may not be fetching the same returns today. Analyze and decide your next investment move accordingly.

Saving is not a onetime plan but a way of life. This is one habit which will fetch positive returns right from the moment you start. May you save up heaps this year only to multiply your wealth for the years to come.

Ten Simple Ways to Boost Your Vision

With computers, tablets and mobile phones, we are constantly staring into screens and forget the damage it does to our eyes. It's time to give your eyes some rest and the TLC they need. Follow these tips to improve your vision and care for your eyes.

Relax your eyes: From the time you wake up until you sleep, your eyes are constantly working. Relax them at intervals. Rub your palm together briskly to ignite warmth in your hands. Cup your palms over your eyes and let them relax. Repeat this exercise through the day especially if you are constantly working on a computer.

Maintain moisture: It is important for your eyes to be moist. Dry eyes can be itchy, red and painful. So from time to time, give your eyes a break and blink to main moisture in your eyes.

Eye exercise: Even your eye muscles require exercise. So do the 20/20/20 exercise as often as you can. Every twenty minutes focus on an object for twenty seconds which is twenty feet away from the eyes. This exercise will help your eyes feel better.

Increase flexibility: Don’t let your eyes stay positioned at one place. Roll your eyeballs about five times at several intervals to increase the flexibility of your eyes and maintain good eyesight.

Decrease screen brightness: If you are working for hours together at the computer, keep the screen brightness minimal. This will help your eyes relax and prevent them from getting strained.

P.S. Don’t decrease the brightness so much that you have trouble reading the text.

Take small breaks: Your eyes need rest too. If you work for long hours at a computer, take short intervals every two hours. If you can’t move around, close your eyes for ten seconds and relax. This will prevent your eyes from getting strained.

UV rays are harmful: Wear a good pair of sunglasses, especially ones that provide UV protection. This actually helps improve your vision.

Feed your eyes: Veggies like carrots, blueberries, apricots are high in beta-carotene that is good for eyesight. Include these items in your daily diet to see visible results.

Avoid wearing lenses too long:  If you already suffer from poor eyesight, don’t worsen it with various contact lenses. Do not wear lenses for more than 19 hours a day and never sleep with your contact lens on. Also, don't forget to clean your lenses regularly.

The cucumber trick: Place slices of cucumber on your eyelids. Cucumbers contain ascorbic acid and caffeic acid which prevent water retention. Cucumbers are considered the best treatment for inflammation and dermatitis of the eyes.

How to become a millionaire: Here are the 10 steps

Getting rich and becoming a millionaire is a taboo topic. Saying it can be done by the age of 30 seems like a fantasy.

It shouldn't be taboo and it is possible. At the age of 21, I got out of college, broke and in debt, and by the time I was 30, I was a millionaire.

Here are the 10 steps that will guarantee you will become a millionaire by 30.

1. Follow the money. In today's economic environment you cannot save your way to millionaire status. The first step is to focus on increasing your income in increments and repeating that.

My income was $3,000 a month and nine years later it was $20,000 a month. Start following the money and it will force you to control revenue and see opportunities.

2. Don't show off. Show up! I didn't buy my first luxury watch or car until my businesses and investments were producing multiple secure flows of income. I was still driving a Toyota Camry when I had become a millionaire. Be known for your work ethic, not the trinkets that you buy.

3. Save to invest, don't save to save. The only reason to save money is to invest it. Put your saved money into secured, sacred (untouchable) accounts. Never use these accounts for anything, not even an emergency. This will force you to continue to follow step one (increase income). To this day, at least twice a year, I am broke because I always invest my surpluses into ventures I cannot access.

4. Avoid debt that doesn't pay you. Make it a rule that you never use debt that won't make you money. I borrowed money for a car only because I knew it could increase my income. Rich people use debt to leverage investments and grow cash flows. Poor people use debt to buy things that make rich people richer.

5. Treat money like a jealous lover. Millions wish for financial freedom, but only those that make it a priority have millions. To get rich and stay rich you will have to make it a priority. Money is like a jealous lover. Ignore it and it will ignore you, or worse, it will leave you for someone who makes it a priority.

6. Money doesn't sleep. Money doesn't know about clocks, schedules, or holidays, and you shouldn't either. Money loves people that have a great work ethic. When I was 26 years old, I was in retail and the store I worked at closed at 7 pm. Most times you could find me there at 11 pm making an extra sale. Never try to be the smartest or luckiest person — just make sure you outwork everyone.

7. Poor makes no sense. I have been poor, and it sucks. I have had just enough and that sucks almost as bad. Eliminate any and all ideas that being poor is somehow OK. Bill Gates has said, "If you're born poor, it's not your mistake. But if you die poor, it is your mistake."

8. Get a millionaire mentor. Most of us were brought up middle class or poor and then hold ourselves to the limits and ideas of that group. I have been studying millionaires to duplicate what they did. Get your own personal millionaire mentor and study them. Most rich people are extremely generous with their knowledge and their resources.

9. Get your money to do the heavy lifting. Investing is the Holy Grail in becoming a millionaire and you should make more money off your investments than your work. If you don't have surplus money you won't make investments. The second company I started required a $50,000 investment. That company has paid me back that $50,000 every month for the last 10 years.

My third investment was in real estate, where I started with $350,000, a large part of my net worth at the time. I still own that property today and it continues to provide me with income. Investing is the only reason to do the other steps, and your money must work for you and do your heavy lifting.

10. Shoot for $10 million, not $1 million. The single biggest financial mistake I've made was not thinking big enough. I encourage you to go for more than a million. There is no shortage of money on this planet, only a shortage of people thinking big enough.

Apply these 10 steps and they will make you rich. Steer clear of people that suggest your financial dreams are born of greed. Avoid get-rich-quick schemes, be ethical, never give up, and once you make it, be willing to help others get there too.
